Competition rules

1. General provisions

1.1. The organizer and sponsor of the prizes in the "NEW taste of peanut butter" competition (hereinafter referred to as the "Competition") is Nutkraft Sp. z o.o. with its registered office in Kraków, ul. Bolesława Prusa 10/18 , 30-109 , entered into the register of entrepreneurs of the National Court Register under the KRS number: 0000915853. NIP: 6 772467020 , REGON: 389659430 (hereinafter referred to as the "Organizer").

1.2. The Organizer is the party promising the prize within the meaning of Article 921 of the Civil Code.

1.3. The Competition is not a game of chance within the meaning of the Gambling Act of 19 November 2009 (consolidated text: Journal of Laws of 2019, item 847).

1.4. The competition is conducted in the Republic of Poland, via instagram.com.

1.5. The competition runs from 20/02/2026, 9:00 AM, to 25/02/2026, 11:59 PM.

1.6. These Regulations constitute the basis for the organisation of the Competition, defining the rights and obligations of its participants and the Organizer.

2. Conditions of participation in the Competition

2.1. Only natural persons may participate in the Competition (hereinafter referred to as the "Participant"), excluding persons referred to in point 2.3.

2.2. A person without full legal capacity may participate in the Competition only if they obtain the prior consent of their legal representative.

2.3. The Competition is not open to employees of the Organizer and members of their immediate family, as well as persons other than those mentioned above who have been entrusted with specific work in connection with the development or organization of the Competition, provided that:

1.a.1 an employee within the meaning of these Regulations is both a person employed under an employment contract and a person cooperating with the Organizer during the Competition on the basis of a civil law contract (in particular on the basis of a contract for specific work, a contract of mandate);

1.a.2 The immediate family of an employee includes his/her spouse, children, parents and siblings, as well as persons living in the same household.

2.4. Participation in the Competition is voluntary and free of charge.

2.5. The rights and obligations related to participation in the Competition, including the right to request the delivery of a prize, cannot be transferred to other entities.

2.6. By entering the Competition, the Participant accepts the Regulations in their entirety and undertakes to comply with the rules set out therein, as well as confirms that he or she meets all the conditions that entitle him or her to participate in the Competition.

2.7 Only persons who are at least 18 years of age, have full legal capacity and reside in Poland may participate in the competition.

3. Competition Rules

3.1. Participants who wish to participate in the Contest are required to post their response in the form of a comment on the @ekogrampl profile on Instagram ("add a comment") and on the @ekogrampl profile on Tiktok to the following contest task: "If we were to create a NEW peanut butter flavor... what would it be? Come up with a name and a short description of the flavor in the comment!"

3.2. Comments may only be submitted during the Competition period specified in point 1.5.

3.3. The Organizer will not allow Comments to participate in the Contest that: 3.4.1. violate generally applicable legal provisions, principles of social coexistence and good manners, in particular violate the personal rights of other people, contain content generally considered vulgar, obscene, offensive, or contain content of a pornographic or erotic nature; 3.4.2. promote or incite violence, hatred, intolerance, in particular on racial, ethnic, religious or political grounds; 3.4.3. present dangerous behavior.

3.4. By placing a Comment on the website referred to in point 1.4, the Participant grants the Organizer unlimited

a territorially and temporally, non-exclusive, royalty-free license with the right to grant sublicenses to use the content of the Comment in the following fields of exploitation: 3.5.1. disseminating the Comment by making it publicly available, performing, exhibiting, reproducing, displaying and broadcasting, including via the Internet and in such a way that everyone can have access to it at a time and place of their choosing on posters, including large-format posters and in all other forms of communication, promotion, advertising, marking and production of goods; 3.5.2. recording and reproducing the Comment, including by printing, reprographic, magnetic recording and digital techniques.

3.5. The Organizer, acting under Article 921 § 3 of the Civil Code, reserves that upon issuing the Prize to the Winner, without the need to pay additional remuneration, he or she acquires all copyrights to the winning Comment, without any territorial or time restrictions, in the following fields of exploitation: 3.6.1. with regard to recording and reproducing the Comment and its derivatives – production by any technique, including printing, reprographics, magnetic recording and digital techniques, 3.6.2. with regard to trading in the originals of the Comment and its derivatives or copies on which the Comment was recorded – placing on the market, lending or renting the original or copies, 3.6.3. with regard to disseminating the work and its derivatives in a manner other than described in point 3.6.1. and 3.6.2 – public performance, exhibition, display, reproduction, making the Comment publicly available in such a way that everyone can have access to it at a place and time of their choice, broadcasting via terrestrial television stations, including via satellite, rebroadcasting, dissemination in the press, on the Internet, on posters, including large-format posters and in all other forms of communication, promotion, advertising, marking and production of goods.

3.6. Along with the transfer of the copyright to the Comment referred to in point 3.6, the Participant also transfers to the Organizer the right to authorize the exercise of the derivative copyright, including the right to dispose of and use the derivative works.

3.7. The Participant undertakes not to exercise any personal copyrights in relation to the Comment and authorises the Organiser to exercise them.

3.8. The Participant is liable for any infringement of copyright in the works used in the Comment. In the event that a third party brings a claim against the Organizer for infringement of copyright in the works used by the Participants in creating the Comment, the Participant agrees to indemnify the Organizer from any obligation to provide any third party with any benefits related to copyright infringement and to cover the full amount of such third party claims, at any request of the Organizer.

3.9. The Participant consents to the Organizer disseminating his/her image recorded on the instagram.com profile and shared in the Comment, and to transfer these consents to third parties.

4. Competition Committee

4.1. In order to select the winner of the Competition (hereinafter referred to as the "Winner") and to ensure the proper conduct of the Competition, the Organizer will appoint a competition jury (hereinafter referred to as the "Competition Jury").

4.2. The Competition Committee selects the winning Comments at its own discretion, taking into account in particular the adequacy, originality and artistic value of the Comment.

4.3. The Organizer will publish the Competition Winner's details on the website https://www.instagram.com/ekogrampl and on the website https://www.tiktok.com/ekogrampl in a comment under the competition post, no later than 5 business days from the end of the Competition.

4.4. The Organizer reserves the right to end the Competition without selecting a Winner.

4.5. The decision of the Competition Committee may not be appealed, which does not exclude the right to lodge a complaint referred to in point 7.

5. Awards

5.1. The competition winners will receive the following prizes:

5.2. In order to agree on the detailed method of issuing the Prize, the Winner is obliged to contact the Organizer via private message on the Instagram profile @ekogrampl and on the Tiktok profile @ekogrampl within 7 days from the date of publication of the Competition results, in accordance with point 4.3. Further contact with the Winner will take place via private messages on Instagram and Tiktok, e-mail, or by phone.

5.3. The Winner is obligated to provide the Organizer with all information necessary to issue the Prize. Providing this information is voluntary, but necessary for receiving the Prize.

5.4. Failure by the Winner to meet the deadline referred to in section 5.2 will be deemed a waiver of the Prize.

5.5. The Organizer shall not be liable for any factually incorrect contact details, residential address and other identification data provided by the Competition Winner, or for any changes to such data not notified to the Organizer, which prevent the delivery of the Prize.

5.6. If the Winner provides incorrect or false information and the Prize sent by the Organizer to the address provided by the Winner is returned to the Organizer, the Organizer will store the Prize at its registered office until the Winner collects it. The Winner may collect the Prize in accordance with the above rules within 30 days of returning the Prize to the Organizer.

5.7. The Prize cannot be exchanged for the monetary equivalent of the Prize or for other items or services.

6. Complaint procedure

6.1. Participants may submit any complaints regarding the manner of conducting the Competition (hereinafter referred to as "Complaints") by registered mail to the Organizer's address.

6.2. Complaints may be submitted during the Competition and within 30 days of the date the Competition results are published. In the case of registered mail, the postmark date will determine compliance with the deadline.

6.3. The complaint should include the Participant's name, surname, telephone number, address of the person submitting the complaint, and a detailed description and justification of the complaint.

6.4. Complaints will be considered by the Competition Committee within 14 days of their receipt.

6.5. The complainant will be informed about the outcome of the complaint by letter or e-mail, depending on how the complaint was submitted to the Organizer.

7. Personal data

7.1. The controller of the Participants' personal data collected in connection with the Competition is the Organizer, i.e. Nutkraft Sp. z o.o. with its registered office in Kraków, ul. Bolesława Prusa 10/18 , 30-109 .

7.2. Providing personal data is voluntary, but necessary for participation in the Competition, issuing the Prize, and considering complaints.

7.3. Personal data will be processed for the duration of the Competition, the period provided for complaint proceedings, as well as for the period of pursuing any claims and for the period required by applicable law, in particular tax law.

7.4. In order to conduct the Competition, personal data may be made available to entities cooperating with the Organizer in the scope

handling the Competition, in particular IT companies, marketing agencies, courier companies.

7.5. Every data subject has the right to access, rectify, and erase their data, the right to restrict data processing, and the right to data portability. Where processing is based on consent, the data subject has the right to withdraw consent, which does not affect the lawfulness of processing based on consent before withdrawal.

7.6. Every person whose data is processed has the right to lodge a complaint with the supervisory authority if they believe that the processing of their personal data violates the provisions of the law on personal data protection.

8. Final provisions

8.1. The Regulations are available at www.ekogram.pl

8.2. To the extent permitted by law, the Organizer reserves the right to make changes to these Regulations, of which it will notify Participants in advance. However, any changes must not infringe on the acquired rights of Participants.

8.3. Amendments to the Regulations apply to Participants who have not previously accepted the Regulations from the moment they are clearly indicated and posted on the website referred to in point 8.1.

8.4. Participants who have accepted the Rules have the right to withdraw from the Competition within 14 days of being notified of the amendments to the Rules. Amendments to the Rules apply to Participants who accepted the Rules after the deadline referred to in the preceding sentence.

8.5. In matters not regulated by the Regulations, the provisions of the Civil Code and other generally applicable legal provisions shall apply.
